GamingChairDesign.com - General Terms and Conditions of Sale

Préambule

The online sales website available at https://www.gamingchairdesign.com, which will be referred to as "The Site", is managed by the company Damien Riou EI, a micro-entrepreneur, with its registered office located at 15 rue des Halles, Paris, 75001, registered with the Paris Trade and Companies Register under number 880835095.

It is specified beforehand that these conditions govern the sales of its products by The Site to any individual or legal entity making a purchase via the website The Site, hereinafter referred to as "the CUSTOMER".

These General Terms and Conditions of Sale, along with the order form and order confirmation, constitute the sales contract between The Site and the CUSTOMER concerning the sale of the ordered products.

Any order placed on the website The Site requires that the CUSTOMER previously accepts the General Terms and Conditions of Sale in their entirety and without reservation.

If there is disagreement with the terms and conditions of the General Terms and Conditions of Sale, the CUSTOMER should not use the Website.

The Site reserves the right to adapt or modify its General Terms and Conditions of Sale at any time and without notice, the adaptations or modifications then being applicable to all orders subsequent to the adaptations or modifications.

In case of modification, the General Terms and Conditions of Sale applicable to the CUSTOMER's order are those that were online, and that the CUSTOMER accepted on the day of placing their order.

Article 1 – Definitions

The terms and expressions identified by a capital letter in the General Terms and Conditions of Sale have the meaning indicated below (whether they are used in singular or plural).

General Terms and Conditions of Sale: refer to this document, i.e., the terms and conditions applying in the relations between The Site and the CUSTOMER.

CUSTOMER: refers to an Individual or Legal Entity, consumer, who uses The Site's Website and acquires one or more Product(s), for their personal needs, having previously adhered to the General Terms and Conditions of Sale.

Article 2. Purpose

These General Terms and Conditions of Sale aim to define the contractual relationships between The Site and the CUSTOMER and the conditions applicable to any purchase made through The Site's website.

By accepting these General Terms and Conditions of Sale, you declare that you have reached the age of majority in your country, state, or province of residence, and that you have given us your consent to allow any minor under your charge to purchase on this online sales site.

The use of our products for any illegal or unauthorized purpose is prohibited.

The company The Site retains the possibility of modifying these General Terms and Conditions of Sale at any time, in order to comply with any new regulations or with the aim of improving the use of its site.

Therefore, the applicable conditions will be those in force on the date of the order by the CUSTOMER.

Article 3. Prices

The prices listed on the product sheets of the internet catalog are prices in Euros (€) including all taxes (VAT included) taking into account the VAT applicable on the day of the order.

Any change in the VAT rate may be reflected in the prices of the products.

The company The Site reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only one applicable to the CUSTOMER.

The products remain the property of The Site until the complete payment of the price by The Site.

Products on promotion will be indicated by a "PROMOTION" sticker or by a crossed-out Price; our promotions are valid as long as stocks last at the time of the order and during the display period.

For CUSTOMERS outside Metropolitan France, The Site is obliged, according to the law in force, to charge VAT on orders shipped to most countries of the European Union.

For CUSTOMERS outside the European Union and DOM-TOM, orders are not subject to VAT, but may be subject to local taxes and customs duties in force in the country of receipt.

These rights and sums do not fall within the remit of The Site.

They are the responsibility of the CUSTOMER.

Warning: Any inaccurate information provided by the CUSTOMER in order to evade VAT can result in civil fines and criminal prosecution.

The prices of the Products indicated on The Site do not include processing and shipping costs, which are charged in addition to the price of the Products purchased and according to the total amount of the order.

Article 4. Order

The contractual information is presented in French and will be confirmed with this contractual information at the latest at the time of delivery.

The company The Site reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.

To order Products on The Site's Website, the CUSTOMER must create an account by providing the required information in the registration form.

To this end, the CUSTOMER declares to provide complete, accurate personal information that allows for precise identification in any situation.

Any fanciful or slanderous personal information may lead to the closure of the CUSTOMER's account and the cancellation of their Order.

The account creation section is directly accessible from the main menu bar.

Each visit, if the CUSTOMER wishes to order or consult their account (order status, personal information, etc.), they will need to log in with this information.

Article 5. Payment

The price of the Products and the logistic preparation and delivery fees are payable in full by the CUSTOMER at the time of placing the Order.

The Site's website may offer the Customer the choice of different means of payment for their order:

Either by credit card: After choosing the payment method by credit card, the Customer is redirected to the secure interface of the payment system to safely enter their personal credit card details. If the payment is accepted, the order is recorded, and the contract definitively formed. Payment by credit card is irrevocable.

Or by bank transfer: After choosing the payment method by bank transfer, and once the order is validated, the Customer receives a confirmation of their order's registration.

To finalize their payment and trigger the processing of their order, the Customer must proceed with the transfer corresponding to the amount of their order to The Site's bank account, the details of which are communicated to the Customer at the end of the order. Once the transfer is received, the order will be processed, and the Customer will be informed by email.

Or by check: After choosing the payment method by check, and once the order is validated, the Customer receives a confirmation of their order's registration.

To finalize their payment and trigger the processing of their order, the Customer must print this order form, accompanied by their check made payable to The Site at the following address: 15 Rue des Halles, 75001, Paris.

No cash payment should be sent. In case of payment by check, it must be issued by a bank domiciled in metropolitan France or Monaco.

Upon receipt of the check, the order will be processed, and the Customer will be informed by email.

The company will ship the products within approximately 10 days, delays for bank verification.

Article 6. Right of Withdrawal

In accordance with Article L121-21 of the Consumer Code, the Customer has a period of fourteen working days from the date of receipt of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty.

The products must be returned in their original packaging, unused, along with the initial Delivery Slip signed. Return costs are the responsibility of the Customer.

Article 7. Delivery

The delivery of Products will take place, after registration of the Order's payment, at the delivery address indicated by the CUSTOMER during the Order process.

An email will be sent to the CUSTOMER to inform of the Products' shipment. The CUSTOMER has the option to choose between different delivery methods.

Shipping costs are calculated based on the chosen delivery method (home, relay point, post office, etc.), the weight of the package, and the destination.

Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be terminated, and the Customer refunded.
